Terms & Conditions

By accessing the Eyes on Spa website, booking a call, or using any of our services, you agree to be bound by these Terms & Conditions. Please read them carefully before proceeding.

1. Services

Eyes on Spa provides digital marketing, client acquisition, and business consulting services exclusively for spa, wellness, and salon businesses. Our services include but are not limited to paid advertising management, AI communication systems, CRM setup, package system design, reputation management, and strategic consulting.

2. Strategy Call & Application Fee

The ₹499 strategy call is a paid application to evaluate whether your spa is a good fit for our system. This fee is non-refundable once the call has been conducted. If you fail to attend your scheduled call without prior notice, you may be permanently removed from future booking availability.

3. Service Agreement

If accepted as a client, the following terms apply:

  • Monthly billing: ₹50,000 + 18% GST (₹59,000/month), billed monthly.
  • No upfront commitment: You may cancel at any time with 15 days written notice.
  • Recommended engagement: 6 months for optimal results.
  • Ad budget: Managed separately by the client. Minimum ₹50,000 in Month 1.
  • Exclusivity: We work with only one spa per locality to avoid conflicts of interest.

4. Performance Guarantee

Eyes on Spa offers a performance guarantee of 3x-5x return on ad spend (ROAS) within 6 months of continuous service. This guarantee is subject to the following conditions:

  • The client must maintain the agreed minimum monthly ad budget throughout the 6-month period.
  • The client must respond to leads and follow the recommended operational processes.
  • The client must not make changes to ad accounts, landing pages, or CRM configurations without prior approval.
  • ROAS is calculated as total attributable revenue divided by total ad spend over the 6-month period.

If the guaranteed ROAS is not achieved and all conditions above have been met, the client is entitled to a full refund of service fees (excluding ad spend and GST). Refund requests must be submitted in writing within 30 days of the 6-month period ending.

5. Client Responsibilities

To ensure the success of our system, the client agrees to:

  • Respond to all leads and inquiries generated by our system within a reasonable timeframe.
  • Provide accurate business information required for ad campaigns and landing pages.
  • Maintain service quality and customer experience at their spa.
  • Pay all invoices within 7 days of receipt.
  • Provide access to required platforms (Google Business Profile, Meta Business Suite, etc.).

6. Intellectual Property

All strategies, systems, frameworks, templates, and materials provided by Eyes on Spa remain our intellectual property. Clients may not share, distribute, resell, or reproduce these materials without written permission.

7. Confidentiality

Both parties agree to keep all business information, strategies, performance data, and communications confidential. Client results may be used for marketing purposes only with prior written consent or with identifying details removed.

8. Limitation of Liability

Eyes on Spa provides marketing and consulting services only. We are not responsible for the client's business operations, staff management, service quality, or any losses arising from factors outside our control. Our total liability shall not exceed the total service fees paid by the client in the preceding 6 months.

9. Termination

Either party may terminate the service agreement with 15 days written notice. Upon termination:

  • All outstanding invoices become immediately payable.
  • Access to Eyes on Spa systems and materials will be revoked.
  • Ad accounts and assets created for the client will be transferred to the client upon request.

10. Governing Law

These terms are governed by the laws of India. Any disputes shall be subject to the exclusive jurisdiction of the courts in Navi Mumbai, Maharashtra.

11. Changes to Terms

We reserve the right to update these Terms & Conditions at any time. Changes will be posted on this page with an updated date. Continued use of our services after changes constitutes acceptance of the revised terms.
